• Attempting to hack or abuse our system security
• Commercial misuse or reselling generated content without authorization

4. Intellectual Property and Content Ownership

4.1 Your Content Ownership

All AI-generated images and content you create using GetMatches.ai remain fully yours. You retain all intellectual property rights and ownership of the generated content.

4.2 License to GetMatches.ai

By using our Service, you grant GetMatches.ai a worldwide, non-exclusive, royalty-free license to use your content solely for:

• Service delivery and technical support
• Quality assurance and compliance monitoring

We will not use your content for external marketing without your explicit consent.

5. Payments, Subscriptions, and Billing

5.1 Subscription Plans

GetMatches.ai offers monthly subscription plans (Starter, Pro, Premium) with varying token allocations and features.

5.2 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You will be charged the current price for your subscription tier.

5.3 Cancellation Policy

You may cancel your subscription at any time. Upon cancellation, your subscription remains active until the end of the current billing period. No additional charges will apply after cancellation.

Our token system includes:

• Model Generation Tokens: Used for training custom AI models (1 token = 1 training job)
• Image Generation Tokens: Used for creating images (1 token = 1 generated image)

Tokens are allocated monthly based on your subscription tier. Unused subscription tokens do not roll over. Tokens are deducted immediately when jobs are initiated and refunded only if the job fails due to technical errors on our end.

7. Referral Program

7.1 Program Overview

GetMatches.ai offers a referral program that allows you to earn commissions by referring new customers. By participating in our referral program, you agree to these additional terms.

7.2 Commission Structure

Affiliates earn 10% recurring commission on all payments made by referred customers for as long as they remain active subscribers. Commission rates may be modified with 30 days advance notice.

7.3 Payouts

Commission payouts are processed through our affiliate platform (Endorsely) via PayPal. Payouts are subject to minimum thresholds and processing timelines as specified in the affiliate dashboard.

7.4 Prohibited Activities

The following activities are strictly prohibited:

• Self-referrals (referring your own accounts)
• Creating fake accounts to generate referral commissions
• Using paid advertising that bids on our brand name or trademarks
• Misrepresenting GetMatches.ai or making false claims about our service
• Spamming or any form of unsolicited bulk messaging

7.5 Program Modification and Termination

We reserve the right to modify commission rates, payout terms, or terminate the referral program at any time. Affiliates found violating these terms will have their accounts terminated and forfeit any pending commissions.

8. AI-Generated Content and Cloaking

GetMatches.ai provides an AI detection cloaking feature that processes generated images to reduce detectability by AI detection tools used by dating platforms.

9. Data Storage and Retention

8.1 Uploaded Images (Dataset)

8.2 Generated Images

Generated images are stored in your account gallery while your subscription is active. Images are automatically deleted within 60 days after subscription cancellation or expiration.

8.3 AI Models

Custom AI models are stored for the duration of your active subscription and automatically deleted within 60 days after subscription cancellation or expiration. Deleted models cannot be recovered.

8.4 Account Deletion

If you delete your account, all personal information (including images and models) is deleted immediately.

Exception: Payment records are retained for 7 years for legal and tax purposes as required by law. These records contain only transaction data (amounts, dates, subscription tiers), not images or personal content.

10. Limitation of Liability and Disclaimers

8.1 Limitation of Liability

Our total liability for any claims arising from your use of the Service is limited to the greater of USD $150 or the amount you paid us in the last 12 months.

8.2 Exclusion of Consequential Damages

We are not liable for indirect, incidental, or consequential damages, including:

• Loss of profits, revenue, or business opportunities
• Loss of data, goodwill, or reputation
• Dating app account suspensions or bans
• Emotional distress or personal harm

8.3 Service Provided "As-Is"

The Service is provided on an "as-is" and "as available" basis. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will result in increased matches or dating success, or that generated images will pass AI detection systems on third-party platforms.

11. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any feature at any time. We will provide reasonable notice for significant changes that affect core functionality.

In the unlikely event of permanent service discontinuation, we will provide at least 30 days' advance notice where reasonably possible.

12. Dispute Resolution and Legal

10.1 Individual Claims Only

You waive any right to participate in a class action or representative legal proceeding. All disputes will be handled individually.

10.2 Time Limit to File Claims

Any claim must be filed within one (1) year after the claim arose. Otherwise, it is permanently barred.

10.3 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date and notify you for significant changes. Continued use after changes constitutes acceptance.
